| PART 1 The following Terms and Conditions set out the basic principles of the business relationships between Autorisk salvage management and the users of the online platform provided by Autorisk salvage management for marketing/fetching a appropriate value for salvage products which may be of different nature and categories. |

| The services provided by Autorisk salvage management,through the www.autorisk.net website (The site) are governed by these Terms and Conditions. (“TERMS AND CONDITIONS” OR “AGREEMENT”).

| By registering with our website as either a buyer or seller on the site (“buyer”,”seller”, or “you” ), you agree to be bound by all of these terms and conditions.If you do not agree to the terms and conditions , you may not use the site to buy ,sell or bid for he goods on the site, or use any other services offered by Autorisk salvage management on the site.

These Terms and conditions may get amended at any point of time as and when required on our site,which shall be effective automatically thereafter, posted on our site,YOUR use of this site after our posting of any changes will constitute your acceptance of such changes or amendment and shall be assumed agreed by you.
The timings, date, place and percentages are not fixed and shall vary depending upon the product and event.
Autorisk salvage management hereby explicitly objects to any counter acknowledgements of contractual partners referring to their own terms and conditions, of any nature.
The platform/site users and any other potential contracting parties acknowledge that they have read carefully and will accept these terms and conditions when registering for the platform/site.
PART 2 (A) The contracting partners/buyers/sellers/you take note of the fact that the vehicles and other products offered for valuation/sale or purchase price bidding on the platform/site are not the property of Autorisk salvage management. Autorisk salvage management is not an auctioneer or a broker/agent instead our site acts as a market place to fetch the appropriate price valuation for the items for sale and buyers to bid.
(B) In none of the procedures described in detail in these terms and conditions does Auto risk salvage management become partner in sales contracts for vehicles/or other goods offered on the platform/site.unless Autorisk salvage management has explicitly agreed with the vendor or buyer,Autorisk salvage management does not issue statements on the sale or purchase of vehicles /or other items in its own name,.however Auto risk salvage management may be authorized to conclude contracts of sale on behalf of the relevant vendor/owner of item/product/ vehicle. Where Auto risk salvage management has been given authority to do so by the relevant vendor,Autorisk salvagemanagement will notify the affected buyer accordingly.
(C) Any agreements reached by the buyers and sellers with respect to the terms of sale of items are solely between such buyers and sellers, as a fact and result we make no responsibilities/no representations or warranties regarding the offered items and have no control over the quality, safety or the ability of buyers to buy items. We cannot ensure that a buyer or seller will actually complete a transaction, as Autorisk salvage management is at no time the owner of the items/vehicles for auction. Autorisk salvage management does not subject these items/vehicles to any technical and /or visual inspection. the description of items/ vehicles ,condition,specification,classification,make ,model,damage,or details is based entirely on the information provide by the owner.
PART-3 (A) Only buyers those who have been authorized by the Autorisk salvage management will be admitted to participate in the platform.
(B) A residential proof, photo, Identification proof, contact no, address residential as well as office, at least 1 guarantor along with earnest money deposit is a must for a buyer to register with Autorisk salvage management.
(C) Admission to the platform is solely on the discretion of Autorisk salvage management, as it reserves the right to reject any admission without giving any reason or to revoke any admission granted earlier. Admission may be revoked in particular for the following reasons.
1. Violation of the provisions of these terms and conditions.
2. Deliberate attempt to advertise incorrect data on the part of offeror’s using salvage exchange.
3. Formation of any cartel/pool among the buyers.
4. Delay in delivery, payment, and collection of products/vehicles bided through the platform/site.
5. Misuse, disclosure of USER ID AND PASS WORD TO ANY UN AUTHORISED PERSON.
6. Violation of applicable laws or rights of a third party, where this affects the interests of Autorisk salvage management in particular with regard to the integrity and reliability of the trade on the platform/site.
7. Use of the marketing platform/site outside the parameters of its intended purpose.
8. Establishing and operation of a marketing platform indirect or direct competition with Autorisk salvage manage ment.
Auto risk salvage management explicitly reserves the right to claim damages in case of any violation of terms and conditions.

PART-4 (A) After admission to the salvage exchange platform of Autorisk salvage management the user is issued a confidential user ID AND A UNIQUE PASSWORD,alongwith access to website/platform.
(B) It is strictly prohibited to pass on the Autorisk salvagemanagement platform/site user id and password to any third party, any contravention will result in immediate exclusion from the user group.Autorisk salvage management reserves the right to claim damages in such cases from violators.
(C) The rights of user are limited to the use of the services provided by Auto risk salvage management in accordance with their intended use.
(D) Autorisk endeavours to ensure maximum possible system security but sudden technical limitations of technology, delays / system failures/server failures/power failures/internet connectivity etc may interrupt the process, though Autorisk salvage manage ment shall make an extra effort for the smooth functioning of the system but in case of any loss or damage caused due to any technical failures, or delay, or any unforeseen circumstances Autorisk salvage management has no liability for such loss if any.
PART-5 The buyers of the items/ vehicles shall be charged a %age fees with each item/vehicle delivery, which shall be taken in advance from the buyer, failure to which shall result in canceling the deal and registration.
PART-6 (A) The offeror/vendor offers items/products/vehicles for disposal on the platform as per agreement with Autorisk salvage manage ment.
(B) The offeror/vendor guarantees the timely submission of complete and correct details for the vehicles/ products/items for sale, regarding nature of loss, amount of loss, godown/vehicle parking/place of inspection/weight and measure, model, manufacturing and registration date, fuel used, ownership serial,colour,version,damages that of technical and optical.
(C) Registered bidders can view the bid rounds/auction dates/timings by logging in the platform.
(D) Once the bid done is considered valid, and if done by mistake should be immediately reported to the management of Autorisk salvage manage ment, via telephone, mobile call, and via email which is mandatory for the transparency of the system of platform/site.
(E) If the highest bidder claims his bid was not valid , the burden of proof is on him, the vendor is entitled , but not obliged to accept this statement as an annulment offer to offer the vehicle /product a new. in case of disagreements regarding the timeliness of a new highest bid the highest bid already accepted remains valid.
PART-7 AUCTION
The vendor/offeror uploads the details, pics and information of the products /vehicles by self or through Autorisk salvagemanagement on the platform and sets a bid or bidding deadline as well as a reserve price. Just by advertising the vehicle/product the vendor/offeror agrees to accept the highest bid submitted by the end of the bidding deadline, provided the bid was issued in accordance with regulations, has reached orexceeded the reserve price the vendor/offeror may have stipulated and the bidder has met any additional conditions the vendor /offeror may have set.
In contrast with the bid system the interested party can follow the bids of competing bidders and outbid them if interested. Each bid submitted is binding. The bid expires if another bidder submits a higher bid before expiry of the bid and bidding deadline.
As soon as the auction /bidding is over the highest bidder is informed about the details to get the delivery of products/items/vehicles by the vendor/offeror who has the sole decision either to offer or reject the bid.
Autorisk salvage management does not guarantee in any form the delivery of products/items/vehicles to the highest bidder if the vendor/offeror does not approve the bid /offer.
PART-8 The vendor/offeror shall provide appropriate no of photographs, third party/legal case information/death case of owner, if any attached with the product/item/vehicle, furthermore the vendor/offeror pledges that he is authorized to freely dispose the product/item/vehicle on offer, be it because he is the authorized owner or because he has the authority to dispose of the item for other reasons.
The vendor/offeror assures both Autorisk salvage management and the buyer that the product/item/vehicle is no encumbered with third party rights, or bank finance/hypothecation /personal loans /overdraft limits on the product/item/vehicle.
PART-9 Provided with the details of collection of products/items/vehicles by the vendor/offeror the buyer has to collect the products/items/vehicles at his expense and without delay, but no later than one week after the information provided and completion of auction bidding process.
Autorisk salvage management shall not be responsible for any shortage of parts,documents,accessories or any further expense claimed by the buyer if any. There stands no guarantee/warranty for the products/items/vehicles offered on the platform/site; all the items/products/vehicles are on as is where is basis.
No claims regarding any negligence or ignorance resulting in any type of loss in terms of time,money,transportation,injuries to life, limb or health shall be entertained by Autorisk salvage management during the delivery process of products by the buyers. The buyers have to ensure the safety of self/workers/employees/labour on their own.
No documentation forms for sale of products/items/vehicles shall be provided b Auto risk salvage management for the completion of deal.
CLAUSE-1 THE HIGHEST OFFER DOES NOT GUARANTEE OR RIGHT TO DEMAND ACCEPTANCE OF OFFER
CLAUSE-2 AUTORISK SALVAGE MANAGEMENT IS FREE TO ENTER ANY NEGOTIATIONS IN RESPECT OF ANY OFFER IN THE INTEREST OF COMPANY.
CLAUSE-3 AUTORISK SALVAGE MANAGEMENT RESERVES THE RIGHT TO ACCEPT OR TO REJECT ANY OFFER FOR ANY REASON WHATSOEVER OR EVEN WITHOUT ANY REASON .
CLAUSE-4 AUTORISK SALVAGE MANAGEMENT DOES NOT RECOGNIZE ANY CLAIM REGARDING TOKEN MONEY TAKEN BY THE BUYERS FROM ANY THIRD PARTY IN LIEU OF ANY SUCCESSFUL BID/UNSUCCESSFUL BID FOR WHICH INSURANCE COMPANY / VENDORS / OFFERER DOES NOT DELIVER THE PRODUCT OR VEHICLE. NO CLAIM SHALL BE ENTERTAINED REGARDING THE ISSUE.
YOU AGREE THAT ANY ACTION AT LAW OR IN EQUITY ARISING OUT OF OR RELATING TO THESE TERMS AND CONDITIONS SHALL BE FILED ONLY IN THE COURTS OF NEW DELHI, INDIA AND THAT YOU HEREBY CONSENT AND SUBMIT TO THE EXCLUSIVE JURISDICTION AND VENUE OF SUCH COURTS.NO ACTION ARISING UNDER OR RELATING TO THESE TERMS AND CONDITIONS MAY BE BROUGHT BY EITHER PARTY MORE THAN TWO YEARS AFTER THE CAUSE OF ACTION HAS OCCURRED.
